The Bidding Business - Service Terms and Conditions

 

1. Services Provided

The Bidding Business provides government-contracting readiness services, including business readiness assessments, vendor registration support, compliance and documentation guidance, certification and classification guidance, capability statement development, business positioning, and opportunity strategy guidance.

The exact services, deliverables, consultations, revisions, registration limits, research limits, support period, and estimated timeline included in the client's purchase are stated on the applicable service or package page and incorporated into these terms.

2. Independent Business Disclosure

The Bidding Business is an independent Florida business. It is not a government agency and is not affiliated with, endorsed by, or acting on behalf of any local, state, or federal government agency.

Clients may be able to complete certain government registrations independently without paying a third-party service provider. Fees paid to The Bidding Business are for professional assistance, guidance, research, document development, and related support.

3. Services Not Included

Unless expressly stated in the purchased service, The Bidding Business does not provide:

  • Proposal writing or preparation

  • Bid submission

  • Legal, tax, accounting, or financial advice

  • Certification or registration decisions

  • Ongoing opportunity monitoring

  • Government filing or application fees

  • Contract-award guarantees

  • Services outside the purchased scope

The client should consult an appropriately licensed professional for legal, tax, accounting, or financial advice.

4. Payment

Payment is required before services begin unless a written payment plan has been approved. Prices and mandatory charges will be disclosed before checkout.

Government filing fees, certification fees, portal fees, printing costs, and other third-party expenses are not included unless expressly stated. The client is responsible for these costs.

If a payment plan is used, the client remains responsible for all scheduled payments. Work may be paused if payment is late or unsuccessful.

5. One-Time Purchase

Unless the checkout page clearly states otherwise, all services are purchased on a one-time basis and do not renew automatically.

If The Bidding Business offers a recurring service in the future, its renewal price, billing frequency, cancellation process, and other renewal terms will be disclosed separately before purchase.

6. Cancellation, Rescheduling, and Refunds

Consultations may be rescheduled once with at least 24 hours' notice. Appointments canceled with less than 24 hours' notice and missed appointments are nonrefundable.

A client may request to cancel a service before work begins. Any approved refund may be reduced by lawful, previously disclosed nonrefundable fees.

Payments become nonrefundable after work begins. Work begins when The Bidding Business performs any part of the purchased service, including:

  • Reviewing an intake form or documents

  • Conducting a consultation

  • Beginning research

  • Providing registration assistance

  • Developing written content or designs

  • Preparing a capability statement

  • Creating an assessment, strategy, or action plan

Any exception to this policy is at the discretion of The Bidding Business unless applicable law requires otherwise.

7. Client Responsibilities

The client agrees to:

  • Provide accurate, current, and complete information.

  • Submit requested documents by the stated deadlines.

  • Review all information and documents for accuracy.

  • Respond to questions and approval requests promptly.

  • Disclose relevant deadlines before purchasing.

  • Maintain control of account passwords and authentication information.

  • Make final decisions and approve information before submission.

  • Pay applicable government and third-party fees.

  • Comply with government requirements applicable to the client's business.

The client is responsible for consequences resulting from incomplete, inaccurate, outdated, or misleading information.

8. Account Security

Clients should not provide The Bidding Business with account passwords, security answers, complete banking information, Social Security numbers, or one-time verification codes through email, intake forms, or ordinary text messages.

When sensitive documents are required, The Bidding Business will provide access to an approved secure client portal. Clients remain responsible for accessing their accounts and completing identity verification or authentication steps.

9. Timelines and Client Delays

Estimated timelines begin after payment and receipt of all required information and documents, unless the service description states otherwise.

Client delays, incomplete information, additional requests, or untimely approvals may extend the estimated completion date. If the client fails to provide requested information for a stated period, The Bidding Business may pause or close the project according to the full service agreement.

10. Government and Third-Party Processing

Government agencies and third-party portals control their own review and processing times. The Bidding Business is not responsible for:

  • Agency or portal delays

  • System outages or technical errors

  • Changed regulations or registration requirements

  • Requests for additional information

  • Application or registration rejection

  • Certification decisions

  • Government deadlines not disclosed by the client

  • Suspension, cancellation, or deactivation of an account

A service timeline refers only to work controlled by The Bidding Business and does not guarantee government approval or activation by a particular date.

11. No Guarantee of Results

The Bidding Business does not guarantee:

  • Registration approval or activation

  • Certification eligibility or approval

  • Eligibility to bid on a particular solicitation

  • Identification of a suitable opportunity

  • Bid selection or contract awards

  • Revenue, profitability, or business growth

  • Acceptance of a capability statement

  • Any specific government-contracting outcome

Government agencies and purchasing organizations make their own independent decisions.

12. Vendor Registration Support

Registration support applies only to the number of vendor systems or portals listed in the purchased service or package. One registration means assistance with one specified portal.

Registration support does not include guaranteed approval, agency processing time, filing fees, or unlimited corrections. The client is responsible for signing required certifications, confirming factual accuracy, completing identity verification, and making legally binding representations.

13. Certification and Compliance Guidance

Certification and classification guidance is based on the information supplied by the client and requirements available at the time of service.

The Bidding Business may provide general information about certifications, classifications, NAICS codes, documentation, and contracting requirements. This guidance does not constitute a formal eligibility determination or legal advice. The responsible organization makes the final decision.

14. Opportunity Research and Guidance

Opportunity and agency research provides general strategic direction based on the client's stated services, qualifications, location, capacity, and goals.

Research does not guarantee that:

  • An agency will purchase the client's services.

  • A suitable active solicitation will be available.

  • The client will qualify for a specific opportunity.

  • An opportunity will remain open or unchanged.

  • The client will receive a contract.

Unless expressly included, opportunity guidance does not include ongoing monitoring, bid matching, solicitation review, proposal preparation, or bid submission.

15. Capability Statement Development

Unless otherwise stated, capability statement development includes:

  • One customized page

  • Writing and organization of information provided by the client

  • A professionally branded layout

  • Two revision rounds

  • Delivery as a final PDF

One revision round consists of one consolidated list of requested changes submitted at the same time. Additional pages, revision rounds, major rewrites, editable source files, and rush delivery require an additional fee.

The client is responsible for reviewing and approving all names, claims, certifications, codes, statistics, experience, and contact information. Requested changes should be submitted within the revision period listed in the service description.

16. Intellectual Property

After full payment, the client may use the final approved deliverables created specifically for the client for lawful business purposes.

The Bidding Business retains ownership of its preexisting templates, methods, processes, layouts, questionnaires, checklists, educational materials, and other underlying intellectual property. Purchasing a service does not transfer ownership of these materials.

Editable source files are not included unless purchased or expressly listed in the service description.

17. Portfolio Use

The Bidding Business will not publicly display a client's name, logo, capability statement, testimonial, or confidential business information without permission.

If permission is granted, the client may withdraw permission for future use by submitting a written request. Materials already printed or published may not be immediately removable.

18. Revisions and Changes in Scope

Requests outside the purchased service's scope may require an additional fee and timeline. Examples include:

  • Additional consultations

  • Additional registrations

  • New research

  • Additional document review

  • Major content rewrites

  • Changes in design direction after approval

  • Additional capability-statement pages

  • Work related to a specific solicitation

The client will be informed of additional charges before out-of-scope work begins.

19. Email Support

Email support is limited to brief questions directly related to the purchased service. It does not include additional consultations, new research, extensive document review, document creation, proposal review, or work outside the original scope.

The support period and normal response time will be listed in the applicable service or package description.

20. Confidentiality and Privacy

The Bidding Business will use reasonable measures to protect confidential client information and will use that information only to provide services, operate the business, meet legal obligations, and perform other purposes described in its Privacy Policy.

Client information may be processed by service providers used for payment, scheduling, secure document storage, communication, and business operations. The Privacy Policy should explain what information is collected, how it is used, how long it is retained, and how clients can submit privacy-related requests.

Florida law imposes requirements concerning the protection of personal information and notification after certain security breaches. Your privacy and security practices should account for those requirements. Florida Legislature

21. Sales Tax and Third-Party Charges

Applicable taxes and required third-party charges may be added at checkout or invoiced separately.

Because Florida tax treatment can depend on the exact combination of consulting, design, digital deliverables, and printed materials sold, the business should obtain Florida-specific tax advice for its particular services. Florida Department of Revenue

22. Limitation of Liability

To the extent permitted by Florida law, The Bidding Business's total liability arising from a purchased service will not exceed the amount the client paid for that service.

The Bidding Business will not be responsible for indirect, incidental, special, or consequential losses, including lost profits, lost opportunities, lost contracts, or business interruption, to the extent permitted by law.

Have a Florida attorney review this provision because enforceability depends on the circumstances and wording.

23. Governing Law and Venue

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, any legal action arising from these terms or purchased services must be brought in the appropriate state or federal court located in Orange County, Florida.
